Is it illegal in Florida to ask for photo ID?
Question: I work for a business, and our owner has required employees to ask for picture ID with any credit card purchase, unless there is a picture already on their card.
Considering just how easy it is to make a fake ID card, I would think that other than having the picture of the person who is presenting the card, it isn't worth the plastic it is enclosed in. Take this fake Homeland Security card or how about the really fake International Driver licenses from Mexico for example. If you trust those, then you probably deserve to loose your money.Comments

With all the credit card theft going on lately I would refuse to accept any credit card transactions without an ID. Heck, I get asked for more information writing a freaking check!

Instead of signing the back of my cards, I write "See ID" and they still don't ask most of the time. |

What is NOT legal is for retailers to ask for your phone number- even when paying by check.
As far as asking for a photo ID, whatever it takes to do whatever we can to protect ourselves as identify theft continues to be the fastest growing crime in America is okay with me! |

That's a good idea to write see id. Some people don't bother signing at all hoping that will prompt the cashier to request id, but that's a big mistake. If you should happen to lose it and someone picks it up, they can sign their own name to the back of it. As long as the signatures match, many cashiers don't bother to look at the name on the front of the card. |

That right there is a good question. Being that I am not an attorney I can't give an official opinion but it is to my understanding that you should have the right to refuse to show a receipt. I recall Christmas shopping at WalMart and being in a hurry. Upon walking out of the store I was stopped by a "greeter", an elderly woman, and ordinarilly I would have been accomodating by showing her my receipt. The problem was that this greeter, who was obviously trying to do her job, had created a line of people waiting to exit the store. Tempers were short among all of these customers trying to exit the store and this greeter was rather assertive in her demeanor. What I ended up doing, because I was in a hurry, is that I gave her my receipt and walked out of the store before matters could become worse. Although it may be perfectly legal for a merchant to have a representative challenge anyone in thier store, I don't think they could have used any type of force in gaining my compliance. The circumstances would be different if as I was walking through the store's anti-theft device and its alarm would have went off, but even then, with the amount of false activations, I do believe that the merchant could be subjected to a lawsuit if they were to use force in order to detain a customer based solely on said activation. Even more so if at the end of the investigation showed that the customer had not actually stolen anything. Although WalMart by far has the best prices anywhere for almost everything, I try to aviod shopping there during peak business hours. I'd love for an attorney to chime in on this one. |

Instead of signing the back of my credit card, I always write on the back where you would sign it "PICTURE ID REQUIRED".
That way, the person stealing and using my CC had better have a picture ID with MY name on it also (to match the name on the CC),, in order to use the card. |

How else would they know if you stole the itmes or not?? |

So you think it's OK for somebody to steal anything they want and just leave the store?? Because if you refuse to show proof that you actually purchased the items, how the h3ll are they going to prove that you bought them or stole them? Either you show proof that you bought the items, or you leave the items in the store. It's as simple as that. |

Huh? Are you asked to show your receipt when you leave the supermarket or a department store? How about a book store? How about KMart? How about numerous other stores that at NO time ask to see your receipt?? |

1 It is NOT customary to be asked to show a receipt upon leaving a store- ANY store- unless they have REASON to think you were shoplifting. And while I do not shop at Walmart, if I ever did and was asked to show my receipt, I would show it and then turn back around, return the item and get my money back and I would be sure to never shop there again! |

1 I can only assume that Walmart, like most stores, has store detectives to keep and eye on shoppers and I would imagine they have security cameras as well that are used as deterrents for would-be shoplifters, as well as proof of shoplifting when it does happen. They have no right to ask for a receipt when you are leaving the store, and then what- they're going to go through your bags to make sure that all the items in your bags are on your receipt? I agree with you and unless they have a reason to suspect someone of shoplifting, they have a lot of nerve asking to see receipts as you leave the store. A low-class move for a low-class shopping experience in a low-class store. Could you imagine an employee at Bergdorf Goodman's or Saks asking to see your receipt as you were leaving the store? For me, this is yet ANOTHER reason to never shop at Walmart! |

Security at the WalMart, dey be lookin for ol, balded white men with baggy shorts. Dey aint stealin' dey is give up da gas from their McDonalds and the bending over is dare bad knees and hips, dats all. While da boyz be just walkin out the door like no care in the world, just a bags and bags of stuff they be sellin to sell to dare friends, for pocket money. |

It's been 20 years since I worked in retail, but back then ALL the big stores had security departments and they damn well knew whether or not you stole something before they ever even appraoched you. I'm sure that it's too expensive for Wal-Mart to do something like that. They would rather let someone's Grandmother get punched in the mouth by some shoplifting thug for asking for his reciept rather than hire and pay a professional. |

I don't shop at Wal-Mart often, but the only time I have ever been asked to show a receipt is when I purchase something and it was not put in a bag (too big or too little for a whole bag) or if I made the security thing buzz. Then, they only check to see if the item that is not bagged or is beeping has been purchased.
They do the same thing at Sams and Costco because they don't bag their products. |

1 Get something straight. I haven't set off an alarm and I haven't been witnessed by a store employee shoplifting. They have Loss Prevention for that purpose. I feel that once the transfer of my money for their items is complete, than the items become my personal private property. When leaving the store, I don't want to be detained and humiliated. It's my property, I shouldn't have to prove I paid for it. Retailers should have to prove reasonable suspicion of theft before detaining and humiliating someone. |

1 WalMart stores have an elaborate camera system and plainclothes store detectives roam around in many of the stores. Having greeters doubled as security/loss prevention agents is another example of corporate greed, but I can see how the money saved by this practice allows WalMart to keep its prices so low. Like many of those who have posted here, I find it offensive to be asked to see my receipt, and I try to avoid shopping at WalMart altogether. |

1 Exactly. Could you imagine walking to the exit at Publix only to have a store employee ask to see your grocery receipt? What has happened to consumer rights in this country- or do we only have the "right" to spend, spend, spend without any right to dignity or privacy? |
