Truth about Frank? He's a road raging maniac who fired shots from his inside his vehicle, after brandishing a handgun (that's three months in jail right there), or do you think that police officers can just go waving their weapons around without so much as showing a badge. That little drunk lady's Nissan didn't pose an immediate threat to Officer White's life. White should have dialed 9-1-1 and requested uniformed on duty officers to arrest Silva for DUI (the hitting of his car was in response to his brandishing the firearm), or maybe your family member in Utah who got you this domain name thinks all San Diego citizens are dumb enough to believe what little you feel like telling us about this case. Officer White better hope I don't get on his jury! Sick that I, as a tax payer, will have to pay these rogue officer's legal bills and the resulting millions that shot kid is going to get from his and his Marine war veteran father's lawsuit.

Chuck-- Are you serious?? I noticed your post of January of 2009... have you not read the updates on this case or are you refusing to look at the facts?? A car is extremely dangerous to people and is a threat to their safety and well being. I don't know about you, but if someone "brandished" a gun, I would try to get away, not go towards them, and especially being a loving mother, never would I put my child in harms way, which obviously this women did during this entire situation. The officers wife did call 911 and requested back up for them. I am not trying to change your point of view, but you need to make your mind up taking all the facts into consideration. I hope too that you aren't on the Jury, because you don't seem interested in TRUTH, OR JUSTICE, and are willing to ignore what is being said JUST TO GET YOUR OPINION ACROSS! Not to have justice served!

Chuck-- One more thing... You don't pay his legal fees, his fellow officers do.. and you should be upset that this woman and the kids father are allowed to sue the City (which is costing you money) when she caused the situation in the first place and continued to be the aggressor. Place blame where it belongs, on the habitual drunk/drugged out lady that continues to endanger herself, her children, and law abiding citizens!

His Mercury was a lot larger model than her Nissan. And had he just stayed in the car, he wouldn't be in any danger. Besides the damage wasn't bad at all. There was just a scratch on both bumpers. I had worse damage backing into someone in a parking lot. He should have just stayed in the car and called 911. Instead of having his wife call while he got out to shoot Silva.

If the two cars were stopped side by side close enough for the mirrors to touch, then how would it be possible for her to "ram" his car from that position, unless her car can drive sideways.
Also, White's Mercury is much larger than Silva's little Honda, so the "threat" is overstated.

I find it amusing that the comments on this story are so ignorant. I can't believe there are people out there that don't know or understand the facts of this case.

Does anyone really think that while under attack of being harmed, people will be thinking, "My car is bigger than their's?" Geez, I guess you are supposed to get out and measure vehicles, and the one with the biggest one has the advantage.

Or better yet, to say this officer is hiding behind a badge... How does one exactly hide behind a badge, when they and everyone involved was cooperative with the police, EXCEPT FOR THE AGGRESSOR, ATTAACKER, DRUNK, DRUGGED, DURANGED, LUNATIC, RAGER?

Ignorance must truly be blissed, and I hope none of the negative commentors ever find themselves in a situation where they are fear for their safety and life, decide to protect themselves, and have to spend 15 months living with haters, unjust prosecution, and the media attacks!

A vehicle is a deadly weapon. Every citizen has the right to protect themselves and others with equal force. I can't believe the D.A. filed this case.

I'm sure the road-raging psycho is just waiting for the jury to convict officer White so she can sue the city of Oceanside. I think they should take her license away forever and send her kid to foster care.

Now we know the truth. He is not guilty, and never should have gone to trial in the first place. Dumanis is an asshole for dragging him and his family through this. I think he should be assigned to the range so he can tighten up his group a little.

Had you been at the trial you would know, he would have hit the driver 4 out of 5 times, the 5th was less than 2 inches from target. Unfortunately the first hit johnnies knee, which is very unfortunate. He is an innocent that was placed in harms way by his mother, and which by testimony and the fact that the boy was reclined behind 94% tint, was not visible to the officer.

the next shot most likely was the miss that passed by the driver and hit the back seat. the next 2 hit the driver in the arm. The last (most likely, since sequence cannot be proved) hit the steering wheel and fragmented.
All while aiming at a moving target under a very stressful situation.

Still think he needs to "hit the range"?

This should have never gone to trial because the officer acted appropriately, as trained. Not to mention the main reason.
He was acting in self defense in a manner that any reasonable person would act. The "threat" doesn't have to be proven, simply proven that a reasonable person would "percieve" a threat.
not that this legalese needed to be applied in this case.

Be honest people. Had you been chased down by a crazy driver, for around 3 minutes (which I guarantee seems like 3 hours while it happens) who proceeds to "act" like they are going to ram your car. then proceeds to cut you off when you try to turn. then cuts you off again, backs up and then pulls next to your door so close that you can't open it. All while revving the engine and squelling tires, and to top it off yelling obscenities at you which may or may not have included, "I'm going to kill you!"

You would then just sit there and wait until the assault was over?
Or you would then tear off at high speed leading this person on a chase around town?

Imagine you are a trained police officer. You are going to try and get the tag number...isn't that what happens at a traffic stop?

a jury of your peers agrees. This was an open and shut case. no question. Unanimous.

Unless you are the scumbag attorney filing a civil case.

Your best comment is now, well we don't have the high level of burden of proof like a criminal case. IE, I just want a free payday!

Well the kid is the victim here.
With his drunken mother and the pysco maniac cop shooting him.
The officer was off duty and chose to engage a deranged drunken idiot in his personal Dirty Harry moment.
He should pay for shooting into a car with a innocent child in the car.
This officer has a prior knowledge of this woman and her family.
Meaning he knew her and may have had a axe to grind with her.
Many people who suffer from drug and substance addiction have no control over themselves.
This officer got out of his car and opened fire in a crowded parking lot.
If the regular Joe Or Jane Smith had done half of this off duty Officers activites he/she would be prosecuted and in jail now.
Officer Frank White and his family have tried to make it seem they are the victims.
Sorry but he is not the victim that little boy who he shot in cold blood and nearly died is the victim.
Sorry Mr White but you have proven you have no impulse control.
This means you should be prepared to write a check for your criminal behavior.

Officer Frank White is a paid professional in law enforcement.
Reading his little confession about being the victim wrong that little boy you shot is the victim.
You can go back to work and live your life.
But that little innocent boy will have physical limitations for the rest of his life.
Quit your crying about what happened you are a participate in the horror this little boy suffered at your hands.
Yes after reading your little blog I now understand you should not have a gun until you have some serious theraphy.
By the way quit boo hooing about what his father is doing worry about civil court and the trial.
The jury may find you repugnant in your behavior and attitude.

Five things about Mr Frank White I already know from reading his little blog.
1.Coward
2.Pyschopathic
3.Gun nut
4.Racist
5.Stalker
All of these things suit Mr White to a tee.
Since a person in their right mind doesn't step out into a open parking lot and shoot into a car and strike and almost kill a innocent child.
He used every trick in the book using Ms Silva's prior arrest to get off on almost murdering a innocent boy.
Sorry Mr White you are a racist and a coward but no victim.
I only hope the whole truth comes out in the criminal trial about your behavior that night.
Remember you may have been found innocent by one jury but the next one might not be so easdy to convince.
Good Luck and I hope you worry will you go to prison when the truth comes out.

But often during civil trials the evidence doesn't have to meet the tougher standards of a criminal trial.
So Mr White's criminal lawyers amy have been able to keep certain behavior of Mr White from the jury and that means they may not have heard everything.

You should be ashamed of yourself! Sounds to me like, you are one of SILVA'S Family or Friends and once again feeling the need to TWIST THE TRUTH, to suit your purpose to bash a POLICE OFFICER!!

This officer didn't know SILVA and her prior behavior regarding the incident that involved him... GET YOUR FACTS STRAIGHT!!!

She chose to ENGAGE him in her DRUNK/DRUGGED/DURANGED blitz!! NOT HIM!! He was reacting to her aggression with the training he was given to be a police officer!!! Pull your head out and get with the program!!

I could go on, line by line, picking your OPINION apart, because it isn't based on ANY FACTS OF THIS CASE! Until you come to the table with TRUTH, FACTS, and an open mind, instead of PURE HATE... Just keep on walking by and don't subject any of us to your ignorant TIRADES!
