Her loss of memory might be attributed to genuine amnesia if the woman had had serious head trauma. But then she would've been unconscious when the ambulence arrived. Instead, she called 911, Worse, her blood alcohol level is WAY above the legal limit -- which means she was just plain drunk and should've told the boyfriend, "Catch a ride with someone else, or take a cab." Since she failed to do that -- and killed another driver and risked her daughter's life as well as her own -- "I'm sorry" is inadequate. She SHOULD face serious charges. What's more, she should lose her license, and custody of her daughter.
