La Habra Heights Couple Still Behind Bars, Preliminary Hearing Postponed

Exclusive Report filed May 21, 2009 Santa Ana - Kimberly Jane Soares, 43, sat inside a segregated inmate cage at the Superior Court in Santa Ana. The La Habra Heights homeowner and Vice President of the La Habra Heights Improvement Association wore a blue jail jumpsuit during her appearance before Judge Vickie Hix Thursday morning. Soares appeared extremely subdued, perhaps knowing she faces as many as 91 years in prison if she's convicted of an alleged multi-million dollar tax and workers' compensation insurance fraud scheme, tied to Democo Corporation, and other companies, jointly owned and operated by Soares and her husband. Joseph Perry Soares, 47, inside a separate wire mesh cage, stood for most of the proceedings, frequently putting his fingers through the steel mesh as he spoke with his defense attorney, Michael F. Currier. Robert Scott Campbell, 26, shared the same cage and orange clothing, stamped with the words, "OC Jail." The Bellevue, Washington resident appeared nervous, with a public defender standing nearby. Campbell's father, James Gregory Campbell, 59, was the only defendant of the four alleged co-conspirators, not behind bars. He showed up in court, wearing a pair of blue jeans and pullover shirt, after he put up a piece of property to ensure he wouldn't skip on his $750,000 bail. His son's public defender asked that Robert Campbell be released on his own recogniscence, arguing that he doesn't have a criminal record. With a job, and relatives in Southern California, the younger Campbell isn't a flight risk. She also stated that Robert Campbell was not named in the original indictment. The Public Defender believed, that perhaps, the District Attorney's Office put him behind bars, with bail set at $2.5 million, so investigators could "squeeze" Campbell for information. Deputy District Attorney Debra Jackson countered that Campbell's name wasn't included in the original indictment because investigators initially thought he might be a victim of identity theft. Jackson added that Campbell was arrested and brought to Southern California because, she insisted, he was involved in the $12 million dollar conspiracy, adding that Campbell's name was used to perpetrate the fraud, and no one forged his signature.
The judge refused the request for an O-R, but agreed to lower Robert Campbell's bail to $1.5 million, the same reduction given to Joseph Soares at a prior hearing. Kimberly Soares’ bail remains at $2.5 million dollars, although it's not clear why she’s more of a flight risk than her husband, who sometimes leases an airplane.

Once the bail reduction hearing was complete, Judge Hix moved on to the issue of the preliminary hearing. In an interesting twist, Joseph Soares and Robert Campbell both insisted on their right to have a preliminary hearing within 10-days of their arrest, even though neither of their attorneys has had the time to plow through 4-thousand pages of discovery. The judge overruled the defendants' requests, postponing the preliminary hearing until July 1st.

Judge Nix stated that it would be prejudicial to all defendants if their attorneys didn't have sufficient prep time to give them an adequate defense.

Great news article regarding the La Habra Heights bullies.
Cover-Up by Improvement Association?
On May 8, 2009, the Vice President of the Improvement Association was arrested on 144 charges including identity theft, forgery and fraud.

In cases of identity theft and forgery; the name, address, phone number, checking account number, and signature of an individual, particularly from an upscale area, are very valuable.
No Comment from La Habra Heights Improvement Association.
The Improvement Association President declined to make any other comment to the Whittier Daily News.
In fact, their December 2007 publication, Heights Life, shows the VP was a director at that time, and for all subsequent issues, so the Vice President has been on the La Habra Heights Improvement Association Board at least a year and a half.
When asked for a statement by the Editor of this website, we were told by President Pam McVicar the only statement they would be issuing is: The Vice President "is on leave of absence from the Board of the LHHIA.
Why does the Association not offer any statement of reassurance to members that their financial information is safe and handled in a secure manner, even in a general way?
Shift in Focus of Story to Improvement Association
With the continued reluctance to offer any further statement to members and the public, focus on the story has shifted from the Vice President to the Improvement Association Board itself.
Most residents know of the Improvement Association for Music in the Park, Easter Egg Hunt, Halloween Haunt and other Social events.
The La Habra Heights Improvement Association receives thousands of dollars in public funds annually from Los Angeles County, above and beyond member dues, advertising revenue, and merchandise sales.
A 2008 email by Association long-time leader/HL Advertising person Jean Good Lietzau, in response to a faux press release on the financial collapse of the city, revealed her own thoughts.
"This Press Release indicates that La Habra Heights continues to
reap the harvest of seven years of incompetent city managers and city council members.
Since 2001, Councils concentrated solely on stopping all building up
here with no regard to the disaster they were creating to city finances.
They hired expensive staff who did not perform their duties. Bruce Douglas, Ed Borrowe, Tela Millsap, Fred Klein, Brian Bergman, Stan Carroll, should take a bow for bringing our small city to this place in time.
What a sad day this is for La Habra Heights as we prepare to celebrate our 30th anniversary of being a city.
I have complete confidence in Council members Layne Baroldi and Howard Vipperman.
I know that they can lead us through this challenging
time and we will remain an incorporated city."

At the May 2009 Council Meeting, Code changes weakening view protection, and allowing more grading and impervious coverage were supported by Councilmembers Vipperman, Westerhoff and Baroldi.
Several public comments opposed the code changes and giving more control to City Staff.
The changes were supported by a Fullerton architect and Improvement Association Director Paul Spothelfer.
A Line Crossed?
The non-political line was possibly breached in the May 2009 Heights Life, with an article attacking legal, informational political mailers, and their author. The article was supplemented with an over 500 word "Letter to the Editor", further castigating the flyers and their author. The letter itself appeared to violate the Improvement Association's own Editorial Policy, excerpted below:
The Future
Residents are once again rising up against the inappropriate development they are seeing in the City.
Residents are opposing the devastating Code changes being proposed to increase development, allow more subdivision, and reduce view protection.
Once again, the Improvement Association is not the leader or participant in opposing over-development.

Mayor Howard Vipperman, errand boy and puppet for the La Habra Heights Improvement Association, was under investigation by the Los Angeles County District Attorney's Office for possible Brown Act violations.
His email to city staff, read into the public record over his vehement objections, told that he wanted to avoid having the public comment, and wanted the staff to craft a hearing before the council so it would be denied.

How much longer before the residents see the connection, and get tired of the bad deeds done under cover of the easter bunny and music in the park?

One of the main themes of Hawthorne’s book was hypocrisy. Hester is depicted as a noble and heroic person, in contrast to those who insisted that she wear the scarlet letter A.
