A state district judge imposed a gag order Friday in the case of a Waco man accused of beating his 5-year-old nephew to death with a belt.

Child Protective Services investigators told a judge Thursday that at this time they don't think the mother of a 5-year-old allegedly beaten to death by his uncle should ever regain custody of her other three children.

Retired State District Judge Sam Bournias ordered drug-testing Thursday for Brandi Mack of Mexia, the mother of 5-year-old Sinsear Jaywon Kirvin, who was beaten to death with a belt at a Waco-area apartment in June.

Christopher Mack, 22, of Mexia, is facing a charge of capital murder and an aggravated assault charge, following the death of a child, and the injury to another, in McLennan County.
