Jerry Coyel said he’s read what others have said on Topix but has never posted himself.
“I don’t fool with computers,” he said.“They’re welcome to come look at my computers.”
Jerry Coyel said he doesn’t believe the Web addresses traced via Topix and Internet Service Providers really led to his business, Apache Iron Metal & Auto Salvage Inc., doing business as Apache Truck and Van Parts.
“I don’t know how they’re supposedly matching these numbers,” he said.“All this is going to do is help my business, get the name out there.”
Early in the suit, Demond acquired a subpoena in a California court, where Topix is headquartered, to compel production of the data necessary to track the defamatory posters.
Demond said he couldn’t comment on how long he expected identifying the remaining 175 screen names would take.
“The Internet Service Providers have been very cooperative,” Demond said.“We sincerely appreciate that they recognize the gravity of the situation.”
Charlie Doescher denied posting on the site as well and said his wife, Jerry Coyel’s office manager, hasn’t either.
“We have absolutely no idea about all that,” Charlie Doescher said.“That’s just BS.”
James Coyel also said he hasn’t posted on Topix.
“I don’t know what you’re talking about,” James Coyel said.“I don’t even know how to operate one of them computers.”
Shannon Coyel was included in the suit because it was the allegations of sexual assault she made that “laid the foundation” for the slanderous Internet chats, Demond said. She is deemed liable only for posts that exclusively concern the sexual assault accusations for which the Leshers were found not guilty, he said.
The lawyer said a jury will have to decide what, if any, damages the Leshers will receive for their suffering.
“The jury will hear evidence of their humiliation, their pain, their loss of income, everything they’ve been subjected to,” Demond said.“You can’t say this stuff on television, you can’t say it on the radio, you can’t say it in the newspaper. If it’s false and it’s hurtful, it’s against the law. If you say it, the law is going to hold you responsible.”
