I'm glad to hear this officer is back on the job. He should now get a medal for his heroic efforts.

As for the scumbag he shot, his mother said "he was only playing with his friends" during an interview.

Well 8 more were sighted at a theme park in Minnisota on July 4th. A 42 year old father took his family there for the 4th (wife and two daughters) where one of the obammites grabbed a groped his 12 year old daughters butt. When the father said somehting the obmmaite had 7 friends help him beat the father to the ground who in now in crititial condition with a brain bleed, fractured skull and ruptured eye socket (amond others). Yes this is a 4th of July the daughters will never forget. Oh the afroamericans all had felon convictions but previous judges thought their not haveing a father, using drugs and their mothrers would not buy them IPods were reasons to let them out. Eight on one gang violence sounds like something from Kenya, Libera or just about any other afronation. Either way Al and Jessy will have to step in and see that these 8 outstanding descendents of slaves do not have their rights abused. Not a blog, just fact!

Doesn't the NYPD have a policy that all officers must remain fit for duty at all times unless they are on sick leave?

Is an officer with a BAC of .08 fit for duty?

Are you saying that they are NEVER allowed to have a few drinks?

The question I posed is at what point is a police officer considered unfit for duty?

Sounds like he was perfectly fit for duty. Out shot a savage with a tec 9. Good job by the officer. He deserves a couple beers for that one...

It is a disgrace that he was treated this way. Save the BAC tests for the cops that shoot their sleeping wives or leave a shooting scene after a road rage incident.

The only thing that makes me think that this cop may have been MILDLY ability impaired is that the scumb@g lived. But I'm sure with some therapy, he will learn to live with that.

Unfortunately, I wasn't shown the same understanding when I tested .07 on a routine stop.

Isn't time to revisit these stupid laws. The breathalyzer is notoriously unreliable and the field sobriety test is junk science at best.

NOT when they are carrying a LOADED gun!
If a P.O. is going out to have a few drinks,(which according to the police, impairs your ability to do practically anything)they should leave their gun at home.

If that what the police wants then they should be responsible for their actions, be it good or bad.

Let's see, off duty, in a bar drinking, with a loaded weapon. I believe that's illegal in n.y. state.Under the cicumstances that became O.K. That is B.S. With a .08 he probably hit the guy by accident.

pigs should be tested on a regular basis for drugs and alcohol. considering how easy it is for them to bend the laws and take advantage of people. Police have the power to do whatever they want and get away with it. i think they should be kept on shorter leashes.

most cops are drunks and coke heads anyways......ive seen people get pulled over plenty of times with drugs and the cops just pocket them and walk away. Ive also seen on duty cops in convenience stores purchasing alcoholic beverages.......i even got some video footage if anyone from the media is interested

Fit for duty and meeting the minimum threshold for DWI are two different standards. A regular drinker who has built up a tolerance for booze may not be noticed with a .09. I don't drink. The same reading would have be very intox.

Tell that to the off-duty cop who was stabbed at a club in Chelsea yesterday morning after he confronted some punks. He wasn't carrying his gun because of this policy, and got stabbed for his trouble when he tried to take police action against some thugs who were threatening some women.

Nobody is saying cops should get drunk while armed. However, the reality is that this policy will result in many off-duty NYPD officers not getting involved when they witness something that requires police action, because they won't be carrying weapons, and know that the NYPD and the City won't back them up if they take any action.

The City used to be able to count on not just on-duty cops fighting crime, but off-duty cops as well. This will no longer be the case. That's good for criminals, but too bad for the law-abiding residents of NYC.

Not only that, but they should also be faster than speeding bullets and be able to leap tall buildings in a single bound.
