Teenager kills Herkimer man in accident, struck him from behind; no charges pending

guess he should have been facing traffic instead of against traffic while walking on a dark street. Hopefully his kid learns what NOT to do by his father's example.

seriously, why would anyone in their right mind take their kid trick-or-treating in an area with no sidewalks and no light much less any more than a couple houses

Where is the compassion? Where is the empathy and grief? A man just lost his life while spending time with his child. A family and friends have lost a loved one.
A young woman will have to live with the fact that she took someone's life unwillingly. Where is the compassion for everyone involved?
While trick or treating in Herkimer the other day numerous adults walked out into the rode not mindful of cars. We all need to be a bit more responsible for our actions and how we affect others, whether it is walking in the road, driving down a dark street or posting anonymous comments online.

good question on what kind of man indeed. They were well past any houses and out by the cemetaries. He was wearing dark clothes and walking in the road in a 45 MPH speed zone with his back to traffic. What the hell was he doing out by the cemetaries with an 8 year old?

OH and I almost forgot. I was out in the village that night at that time with my kids also trick or treating. We didn't get hit by any cars because we were actually out where there are houses and also being careful of traffic. This guy got himself killed because he was stupid. There is no compassion for stupidity.

compassion has nothing to do with LIFE..bad things happen to good people and vice versa..he could have just been listening to the kid who wanted to "SEE a CEMETERY" on halloween.or had friends in ilion (i walk the road a lot...does that make me stupid or JUST LUCKY?).dont know and the answers and he's not here to tell you.
the only one who knows now sits as judge of his life..
live YOURS like yours matters and maybe you'll have one....life belongs to the living not the whiners.(ps. the word is ROAD )

Trick or Treating should be held in the daylight hrs. on a Saturday when parents are home from work. The best time would be from 2pm - 4pm.

Some of you are ruthless. Am I one of the few left with a good conscience and compassion? I would feel terrible saying the guy died and it was his own fault. You judgers are evil. The other poster was right, you don't know if his child wanted to see a cemetary or maybe he didn't have a car and he had to walk. How can you judge like that? I would feel terrible but then the world is getting worse. Shame on all of you judgers. Hopefully if you die by accident people won't be posting on here how stupid you were without knowing the facts.

I heard he was walking back to frankfort where he lived. If thats the case why was he walking on route 5 with a kid, especially in the rain! I agree with jenna trick or treating should be earlier as well as on the same day as the other towns around us. How much candy do our kids need many people that i know go to two different towns on both nights.

The important word here is accident. The hows and whys really don't matter now do they. I'm sure the girl who hit him didn't plan on it anymore than he planned on getting hit. Sometimes Sh*t just happens. All you a-holes on here that are judging the situation need to remember that a child will be without his father and a young girl will forever be reminded of what happened. An accident. That's all. Move on and go crap on some other stupid thread. This isn't the place for that.

Halloween was his favorite holiday and he wanted to make the best of it for his son. He was heading to a friends for dinner at 7 which is when trick or treating ended and was tragically taken from us, not to mention this all happened infront of his beloved child. Everyone is so fast to pass judgement without ever knowing the facts.

Both Preston and Jessica were at fault. Yes he was wearing dark cloths and walking with traffic, but as the paper says, it was drak, raining and visiability was poor (not to mention it was Halloween with many kids out on the streets) so to justify that she was not speeding, 45 mph seems pretty fast for the conditions presented.

Now there are two young lives that will be forever scarred, Austin & Jessica. No one wins here - no one!

I tell you what, nothing ever surprises me anymore, all of you people that have the nerve to judge this situation are worthless pieces of s**t, and you dont deserve to breath the same air as the young boy that just lost his father. you better pray to someone who will listen that a tragedy like this never happens to you or someone you love. when your day comes? you should all rot in hell for your lack of compassion.

No comment on the tragic accident..but what I just cannot get over is how few people can correctly spell CEMETERY. (not cemetARY). I lament the closing of LW Bills School.
