Normally, I hate lawsuits. But this one, I like. And I like that the town is going to get its butt kicked even harder when the civil lawsuit goes through. You can't stick your foot on the neck of citizens without the citizens fighting back sometimes - sucks doesn't it? Choke on the fine.

Once again the community gets screwed over by land developers, looking to make a quick buck by building crap houses on tiny lots to maximize profit. Well congratulations, you won the right to build your 70-something houses and further clog the Bellmore with traffic, congestion and school overcrowding. So who's really winning here?

At least under the zoning change there would be affordable housing for the ever-increasing senior population as well as a safe place for them to congregate... Now the problem is just stretched further

uhmmm, question here

HOW are they going to build, when the land has not been CLEANED, the Belmore factilty made that land a TOXIC DUMP,,,dont think many want to own a home built on top of that

well it would be amazing if one day a builder actually made affordable housing for the declining age group of 20-40 on LI...what is the point of all the senior housing if this age group will no longer be here to purchase in these developments

It's people like you that believe the government should control private property at the expense of the owner. The owner follows the rules in place, but since you and your ilk don't like it, you seek to change the rules after the fact. Furthermore these actions use the "unlimited" resources of government to force your misguided views on others, all at the expense of the risk taking owner. But but but its for the chilllldren...

Long Island needs more housing (i.e. population) like an infection needs more bacteria. Imagine this: If you are a working person who pays exorbitant taxes, utility bills, etc, like I do, then you would love to see a quality of life commensurate with that cost. If the property and open spaces on LI was protected (moratorium) values would go up immediately. Quality of life would not continue to decrease due to ever-increasing congestion, pollution, overcrowding at schools, crime, etc. The value of LI might come up to par with the tax we pay (and have been paying for decades). Let the rapers of the land build in the wastelands (Texas redneckland, Florida swamps, Nevada deserts, etc.), where it doesn't matter, instead of the last pristine tracts of a once beautiful sanctuary. Hell, if Israel can turn a barren desert into a thriving oasis country, it can be done elsewhere. No need to further the damage to LI.

Overpopulation is the bane of our time, Especially given the “distribution” of population increase. You know who you are… Put on a condom.

If this sounds unfair, it is. Fairness is irrelevant. Nothing in life is fair, nor is it intended to be. If it was about fairness, we’d give it all back to the Native Americans we stole it from in the first place.

Well, seeing as you're an ex-developer you would know how it works, and judging by your use of language you're not one to care for the children of our community, you're probably one of the ones we should be protecting our children from.

Obviously, the current method of planning doesn't work. LI is among the most expensive places to live in the country, with a limited amount of land to develop. The Bellmore site bring only problems to the community: traffic, overpriced housing, and using up every last acre of open space in the town. There are no clear advantages to building such a development there. Because of this, the town should be allowed to intervene and force the developer to create a plan that would have something to offer the community instead of just a burden.

And as others in this forum have said, there's a need for affordable housing on LI, for all age groups, not just seniors. But you're not interested in that. Like most contractors and developers, you just want to make your buck and leave. That attitude may have worked fifty years ago, but not anymore. Developers should consider the impact of hat they build before they build it. And if the town has to force them to, then so be it.

That's exactly what is needed here. Just as Levittown was built for POOR working class folks, more needs to be built to keep our young here. They're all going south or out west where homes cost $150,000, with the SAME services we get for HALF or less taxes.

"officials said they expressed an interest in developing the prop. 13yrs ago & thought they an agreement with D of D".by '05 they still did nothing,D of D got fed up waiting & sold to BLF.oooops!!!realizing they screwed up big time they try to illegally change the zoning but ran into someone wouldn't back down.. now their arrogant ineptness will cost those who kept voting these bumblers for multiple terms will pay for their foolishness(to bad those who didn't vote for them must suffer also)...clean house in nov. voters!!!!

I agree with your post. Also, if the TOH wanted to develop that property they should have instead of expecting a private developer to pay for what the TOH wanted, changing their laws at will to force the issue.

The NYS Court of Appeals ruled in favor of the private owners right to develop the property by building single family homes, even though the TOH's attempt to block it by changing their zoning, this time, didn't work.

This was an important ruling where government overstepped and attempted to control a private business and was legally stopped from doing so.

Going forward this court ruling should be the model, a standard, if the same tactics are employed on other land use projects. It's too bad millions of dollars of the Town taxpayers, and the developer's, money was lost proving and appealing this case.

I Love it 'Jimmy Crack Corn'. You got it right. When will the morons in Long Island zoning get the point that stealing private money for pet projects has to stop? If we need more Welfare housing,then it should come our of our bloated town budgets. Choke on the Fine - I wish I had said that! More power to the Taxpayers!
