Inmate sues CCA after being attacked

An inmate who had his ear ripped off during an attack by another prisoner in Wayne County has filed a lawsuit against Nashville-based prison operator Corrections Corporation of America.

According to the lawsuit, 33-year-old Kevin Swafford claims his ear couldn't be reattached because he did not receive proper treatment after the attack. He also says the staff was negligent and his civil rights were violated.

Prison officials say Swafford was attacked in March 2007 at the South Central Correctional Center in Clifton in Wayne County. Read more

Five weeks before he plans to step down as chief executive of United Technologies Corp. , George David and UTC late Sunday announced a nearly $3 billion hostile takeover bid for Diebold Inc. of Ohio , which makes automated teller machines and other equipment for the financial services and security businesses.

Diebold, which had fiscal year 2006 revenues of $3 billion, has stiffly rebuffed previous acquisition attempts by UTC and did not respond to UTC's latest offer, made by letter Friday, according to Gregory Hayes, UTC's vice president for accounting and finance. Diebold representatives could not be reached for comment Sunday night. Hartford-based UTC has offered to pay $40 per share in cash for all outstanding Diebold shares, a 66 percent premium on Friday's close of $24.12, down dramatically in the last six months. The company has been under investigation by securities regulators for accounting practices. On Feb. 6, Diebold said it was restating revenues, and, facing a slowdown in bank branch construction in the United States and a delay of a major lottery project in Brazil, the company said it was cutting 800 jobs, or 5 percent of its total, on top of a $100 million cost-cutting plan already underway. With Diebold cooperation, UTC said it could probably complete a deal within 30 days. If successful and completed quickly, an acquisition of Diebold would rank among the biggest of David's 14-year tenure as leader of UTC, Connecticut's largest private employer. In 1999, UTC paid more than $4 billion for Sundstrand Corp., now part of UTC's Hamilton Sundstrand unit. In 2003, it paid about $2 billion for Chubb, the British security device company. And in 2005, it paid about $3 billion for Kidde, also a security company. Chubb and Kidde are now part of UTC Fire & Security, a fast-growing UTC division that would likely benefit from an acquisition of Diebold. Diebold has about 17,000 employees. UTC, which had 2007 profits of $4.2 billion on sales of $55 billion, has more than 220,000. Read more

EKU announces plan to save energy
