Grand jury wants more evidence regarding $20,000 missing from county

A Lincoln County grand jury has asked to hear more evidence in the investigation regarding slightly more than $20,000 that went missing from county coffers.

“Detective Mark Young has presented his case to a grand jury,” Trooper Chris Lanham said Monday. The jurors said they wanted to hear from more witnesses. He will re-present his case on Nov. 25.”

From mid-July to mid-October of 2007, no fees collected at the Planning and Zoning office were taken to the courthouse for bank deposit, said County Treasurer Teresa Padgett and Judge Executive R. W.“Buckwheat” Gilbert.

The deposits should have been made regularly, perhaps once a week, they said.

The job of making sure the money made its way from P&Z to the county treasurer’s office fell directly to then-P&Z secretary Cindy Portwood, who resigned before the funds were discovered missing. Portwood said she left for a higher-paying job.

In a related matter, Portwood recently filed a lawsuit against Padgett and Gilbert, alleging they defamed her by suggesting to the media that she stole the money.

Their alleged statements injured and damaged Portwood's reputation, the lawsuit claims.

Portwood has said she transferred the funds from the P&Z office to the courthouse during the time in question.

The lawsuit seeks an unspecified amount of compensatory and punitive damages from Gilbert and Padgett for "embarrassment, humiliation, emotional distress, mental anguish, loss of income and damage to reputation ..."

Portwood tendered a two-week notice Oct. 19. On Nov. 2, her last day at work, her co-workers treated her to lunch at the Depot Restaurant and gave her a going-away gift of a wooden angel.

In a telephone conversation shortly after the money was reported missing, Portwood emphatically denied any wrongdoing and said she’s being framed for her inside knowledge of political shenanigans.

“Now I know how people feel who get caught up in the court system and who are innocent,” she said at the time.

The money turned up missing when people who had paid fees asked why their checks hadn’t cleared, Gilbert said.

Gilbert said he thinks someone shredded the checks to cover their tracks after stealing the cash.
