2) Coal Run isn't in the city limits of Zanesville. By Law, they have no obligation to provide water service outside their city limits. That puts a real question mark on 20% of the claim.
3) Every Black in the city of Zanesville has had water. More serious question marks about the racism factor of the case.
4) Coal Run was not the only community outside Zanesville without water. More questions about the racism factor.
5) U.S. District Court Judge Algenon L. Marbley may or may not have suppressed testimony supporting the Counties position. More to be seen on appeal, but Lawyers don't normally lay bait, especially about Judges, in the press for fear of being disbarred.
6) The appeal will only be heard by a Judge, not a jury.
But let's imagine they do win the appeal. Let's say $3 million.$1 million or more off the top goes to the New York Lawyers for fees. That leaves each of the 70 complaintants, most who don't even live in Coal Run anymore, with about $28,571 before taxes. When they finally get it, that is. Both the City and County can defer indefintely while bonds are voted on and issued. But at what cost? The money has to paid out of local coffers, which in turn degrade Schools and Police protection from the County, and Police, Sewer and Garbage services from the city. This will anger the residents (96% White), especially the citizens of Zanesville, who had no legal precedence to run water lines to begin with. The Blacks of Coal Run should expect to feel the brunt of these degraded services, even though most weren't the actual beneficiaries of the settlement. The leading industry of the area, Longaberger, which employs 7,700 residents in the 86,000 person county will have to bear the brunt of local corporate taxes being raised to pay the bill, and that could easily have bearing on employment in the community, especially with the influx of Hispanic immigrants. It gives them a good excuse too.
So, you see, while miniscule "gains" were made...in the long run, you may not win after all. If the appeal even lets the verdict stand, which is highly suspect. Ohio Attorney General Nancy H. Rogers may have said she was pleased, but she's not paying the bills, and nobody would want to see Jesse and Al on their doorstep. But nobody wants to pay this either.

Yes, apparently calling someone a "loser" and simulating laughter with typed words is a debate tactic around here. That's just it I suppose, tactics.
